(Regulation Foundations: In Practice)
1. Overview
These Terms and Conditions ("Terms") govern your participation in "Regulation Foundations: In Practice" ("In Practice", "the Programme"), owned and operated by Alena Winter Natural Health ("we", "us", or "our"). By enrolling in In Practice, you agree to be bound by these Terms.
2. Programme Description
In Practice is a 12-week group coaching membership for graduates of the Regulation Foundations course. It is designed to support you to integrate the teachings of Regulation Foundations into your daily life, at a slower and more intentional pace, with ongoing support and accountability alongside a small group.
In Practice is an educational programme grounded in holistic, naturopathic, and evidence-based approaches. It is not therapy, counselling, or medical treatment, and it is not a replacement for these.
3. Eligibility and Suitability
3.1 In Practice is open to past students of the Regulation Foundations course. This founding round is offered by invitation.
3.2 In Practice is not suitable for individuals under 18 years of age, and enrolment by minors is strictly prohibited.
3.3 It is unsuitable for individuals experiencing acute mental health challenges, severe trauma, or chronic conditions without prior consultation with their healthcare provider.
3.4 By enrolling, you confirm that you are in a safe and stable place to take part in this programme.
4. Health Disclaimer
4.1 In Practice is not a substitute for professional medical advice, diagnosis, or treatment. You are encouraged to consult your healthcare provider before taking part, especially if you have any pre-existing medical conditions, mental health concerns, or are pregnant.
4.2 If you are already working with a healthcare provider, therapist, or other professional support, you are encouraged to continue doing so throughout the programme. In Practice is designed to complement, not replace, existing healthcare plans.
4.3 Participation is at your own risk. In Practice does not claim to diagnose, treat, cure, or prevent any disease or condition.
5. What's Included and How It's Delivered
5.1 In Practice runs for a founding term of 12 weeks and includes:
a) Live group calls. Approximately one live group call every four weeks across the term, each running 60 to 90 minutes. Call times are confirmed with the group and we will endeavour to work with everyone's timezones. Calls are recorded, and you will have the opportunity to submit questions beforehand so they can be answered even if you cannot attend live.
b) A private community space. A dedicated space for our group to stay connected and inspired between calls.
5.2 In Practice is delivered through the Kajabi platform. Live calls are hosted online.
5.3 Access to the community space and to call recordings is available for the duration of your active membership. If your membership ends and is not renewed, your access will end.
6. Founding Round and Renewal
6.1 This is the founding round of In Practice, offered as a 12-week term.
6.2 Whether and how In Practice continues beyond this founding round will be reviewed after the term. Any renewal or ongoing offering, including its pricing and format, will be communicated to members at that time.
6.3 The founding term does not automatically renew. You are under no obligation to continue beyond the 12 weeks.
7. Community and Live Call Participation
7.1 In Practice includes access to a private community space hosted in Kajabi, and to live group calls.
7.2 Both the community space and the live calls are designed to provide a safe and supportive environment for sharing, connecting, and supporting one another.
7.3 Rules of conduct in the community space and during live calls include:
a) Respectful communication: participants must engage respectfully and courteously with others, both in the community space and on calls.
b) Confidentiality: participants must not share other members' personal details, discussions, or contributions, whether shared in the community space or during a live call, outside the group.
c) No harassment or abuse: disruptive, offensive, or inappropriate behaviour will not be tolerated.
d) Intellectual property respect: participants may not share or reproduce any community content or call recordings outside the group without explicit permission.
e) Constructive participation: contributions should align with the supportive intent of the group.
7.4 Participants may choose by mutual agreement to connect outside of the community space (for example, as accountability partners). Any such external arrangement is at the sole discretion of the participants and is not our responsibility.
7.5 Breaches of these rules may result in removal from the programme without a refund. Decisions regarding removal are at our sole discretion.
8. Payment Terms
8.1 The founding term fee is USD $247 for the 12-week term, paid in full at enrolment.
8.2 Payment is processed via Stripe or PayPal on the Kajabi platform.
8.3 Price includes GST (15%) for NZ residents.
9. Refund Policy
9.1 In Practice is a small, committed group container, and its value depends on everyone showing up for the full 12 weeks. For that reason, the founding term is paid in full and non-refundable once the term begins.
9.2 If extenuating circumstances arise that mean you are unable to continue participating, please contact us as soon as possible.
10. Intellectual Property
10.1 All programme materials, including call recordings, audios, and other resources, are the intellectual property of Alena Winter Natural Health.
10.2 You are granted a personal, non-transferable licence to access and use the materials for your own educational purposes only.
10.3 Sharing login details, redistributing materials or recordings, or using them for commercial purposes is strictly prohibited without prior written permission.
11. Participant Responsibility
11.1 You are encouraged to use discretion and listen to your own body when engaging in any practices suggested in the programme, and to modify or stop a practice if you feel discomfort, distress, or harm.
11.2 It is your responsibility to ensure your environment is safe for engaging in any practices.
11.3 If at any time you experience distress, feel triggered, or find the content overwhelming, you are encouraged to seek 1:1 professional support from a qualified mental health practitioner. You should not feel pressured to "push through" discomfort, and should prioritise your wellbeing.
11.4 Results will vary based on individual commitment and consistency. Long-term benefits require continued practice, and you are encouraged to integrate the tools into your daily life for sustainable progress.
11.5 You are responsible for recognising when additional support may be needed, and are encouraged to consult your healthcare provider or a trusted professional if your mental or emotional state changes during the programme.
12. Limitation on Claims
12.1 In Practice does not guarantee specific outcomes or results. While the tools and approaches are evidence-based, individual results vary depending on personal circumstances, engagement, and consistency of practice.
12.2 Any statements relating to nervous system health and emotional regulation are based on general principles and should not be interpreted as guarantees.
13. Indemnity
13.1 By enrolling, you agree to indemnify and hold harmless Alena Winter Natural Health and its representatives from any claims, damages, or liabilities arising from your participation, including but not limited to injuries, misinterpretation of content, or failure to achieve desired outcomes.
14. Force Majeure
14.1 We are not liable for delays, interruptions, or changes to the delivery of the programme, including the rescheduling of live calls, caused by events outside our reasonable control, including but not limited to acts of God, illness, technical failures, platform outages, or governmental restrictions.
15. Use of Testimonials
15.1 By enrolling, you agree that anonymous feedback or testimonials you provide may be used for marketing purposes. Personal identifiers will only be included with your explicit written consent.
16. Privacy and Confidentiality
16.1 We respect your privacy and will only use your personal information for the delivery and support of the programme.
16.2 You are expected to maintain the confidentiality of other members. Anything shared by members within the community space or during our live calls must be kept confidential and must not be shared outside the group.
17. Limitation of Liability
17.1 To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, or consequential damages arising from your participation.
17.2 Our total liability is limited to the amount paid for the founding term.
18. Amendments and Updates
18.1 We reserve the right to amend these Terms as needed. Participants will be notified of significant changes.
18.2 Continued access to the programme constitutes acceptance of the amended Terms.

20. Governing Law and Dispute Resolution
20.1 The laws of New Zealand govern these Terms.
20.2 Any disputes will first be addressed through direct communication. If a dispute cannot be resolved informally, it shall be submitted to mediation or arbitration in New Zealand, and is subject to the exclusive jurisdiction of New Zealand courts. The costs of mediation or arbitration will be shared equally between both parties unless otherwise agreed.
