(Regulation Foundations) 

1. Overview These Course Terms and Conditions ("Terms") govern your participation in the "Regulation Foundations" course ("the Course"), owned and operated by Alena Winter Natural Health (“Course Creator”, “we," "us," or "our"). By enrolling in the Course, you agree to be bound by these Terms.


2. Course Description
The Course is an 8-week online educational program designed to teach foundational principles of nervous system regulation using holistic, naturopathic, and evidence-based approaches. It is not a replacement for therapy or medical treatment.


3. Eligibility and Suitability

3.1 The Course is not suitable for individuals under 18 years of age, and enrollment by minors is strictly prohibited.

3.2 The Course is intended for individuals seeking tools to manage stress better, improve emotional regulation, and support overall well-being.

3.3 It is unsuitable for individuals experiencing acute mental health challenges, severe trauma, or chronic conditions without prior consultation with their healthcare provider.

3.4 By enrolling, you confirm that you are in a safe and stable place to undertake this educational journey.

4. Health Disclaimer

4.1 The Course is not a substitute for professional medical advice, diagnosis, or treatment. Participants are encouraged to consult their healthcare provider before starting the Course, especially if they have any pre-existing medical conditions, mental health concerns or are pregnant.

4.2 Participants who are already working with a healthcare provider, therapist, or other professional support are encouraged to continue doing so throughout the Course. This Course is designed to complement, not replace, existing healthcare plans.

4.3 Participation in the Course is at the participant's own risk. The Course does not claim to diagnose, treat, cure, or prevent any disease or condition.

5. Course Structure and Delivery

5.1 The Course includes weekly video modules, downloadable resources, and access to a private online community.

5.2 Course materials will be delivered through the Kajabi platform, with new modules released weekly.

5.3 Participants will retain ongoing access to the Course materials for the lifetime of the Course, subject to the continued availability of the hosting platform and our ongoing operation of the Course. 

 

6. Private Community Participation

6.1 The course includes access to a private community hosted in Kajabi.

6.2 This community is designed to provide a safe space for sharing, co-regulating, and supporting one another.

6.3 The private community is only active for the duration of the Course and will not remain available after the 8 weeks.

6.4 Rules of conduct within the private community include:

a) Respectful communication: Participants must engage respectfully and courteously with others.

b) Confidentiality: Participants must not share personal details, discussions, or content outside the community.

c) No harassment or abuse: Disruptive, offensive, or inappropriate behaviour will not be tolerated.

d) Intellectual property respect: Participants may not share or reproduce any community content outside the group without explicit permission.

e) Constructive participation: Contributions should align with the supportive and educational intent of the group.

6.5 Participants may choose by mutual agreement to connect outside of the private community (e.g., accountability partners and study pods). Any such external communication or arrangement is at the sole discretion of the participants and is not the responsibility of the course creator.

6.6 Breaches of these rules may result in removal from the community without a refund. Decisions regarding removal are at the sole discretion of the Course Creator.

7. Participation Requirements

7.1 No prior knowledge is required to join the Course.

7.2 Participants are encouraged to watch all video modules, engage in the community, complete exercises, and integrate the tools provided to achieve optimal results.

7.3 Results will vary based on individual commitment and consistency.

7.4 While the 8-week Course provides foundational knowledge and initial progress, long-term benefits require continued practice beyond the Course duration. Neuroplasticity and behavioural change take time, and participants are encouraged to integrate the tools and techniques learned into their daily lives for sustainable progress.

7.5 Results will vary based on individual commitment and consistency.

8. Payment Terms

8.1 The full Course fee is USD $590. A payment plan option is available consisting of two monthly payments of USD $315 (total USD $630).

8.2 Payment is processed via Stripe on the Kajabi platform, or PayPal.

8.3 Price includes GST (15%) for NZ residents. 

9. Refund Policy

9.1 A full refund is available within the first 7 days (before the release of Module 2) if you decide the Course is not suitable for you.

9.2 Refund requests must be submitted in writing via email and may include a brief feedback form.

9.3 Refunds will not be provided after the second module is released.

9.4 Refund requests outside the standard 7-day window due to illness or extenuating circumstances will be considered on a case-by-case basis. Documentation may be required to process such requests. However, refunds will not be granted once a significant portion of the course materials (e.g., multiple modules) have been accessed.

10. Intellectual Property

10.1 All Course materials, including videos, PDFs, and other resources, are the intellectual property of Alena Winter Natural Health.

10.2 Participants are granted a personal, non-transferable license to access and use the materials for educational purposes only.

10.3 Sharing login details, redistributing materials, or using them for commercial purposes is strictly prohibited without prior written permission.

11. Participant Responsibility

11.1 Participants must use discretion and listen to their own bodies when engaging in practices suggested in the Course.

11.2 The Course encourages autonomy and self-awareness, and participants are advised to modify or stop practices if they feel discomfort, distress, or harm.

11.3 It is the participant's responsibility to ensure their environment is safe for engaging in any practices taught in the Course.

11.4 If at any time during the Course you experience distress, feel triggered, or find the content overwhelming, you are encouraged to seek 1:1 professional support from a qualified mental health practitioner. Participants should not feel pressured to "push through" discomfort and should prioritize their wellbeing.

11.5 Participants must be willing to make positive changes in their lives, approach the material with an open mind, and commit to the best of their ability to show up for themselves throughout the Course.

11.6 Success in the Course depends on consistent engagement and personal effort. While participants are encouraged to move at their own pace, they should actively participate in exercises and apply the tools provided to maximise benefits.

11.7 Participants are responsible for recognising when additional support may be needed. They are encouraged to consult their healthcare provider or a trusted professional if their mental or emotional state changes during the Course.
 

12. Participant Conduct

12.1 Participants must behave respectfully and non-disruptively within the private community.

12.2 The Course Creator reserves the right to remove individuals for inappropriate conduct without a refund.

13. Limitation on Claims

13.1 The Course does not guarantee specific outcomes or results. While tools and techniques are evidence-based, individual results may vary depending on personal circumstances, engagement with the material, and consistency of practice during and after the course.

13.2 Any claims related to nervous system health and emotional regulation are based on general principles and should not be interpreted as guarantees.

14. Indemnity Clause

14.1 By enrolling in the Course, participants agree to indemnify and hold harmless Alena Winter Natural Health and its representatives from any claims, damages, or liabilities arising from their participation in the Course, including but not limited to injuries, misinterpretation of content, or failure to achieve desired outcomes.

15. Force Majeure

15.1 The Course provider is not liable for delays, interruptions, or failures in the delivery of the Course caused by events outside reasonable control, including but not limited to acts of God, technical failures, platform outages, or governmental restrictions.

16. Use of Testimonials

16.1 By enrolling in the Course, participants agree that anonymous feedback or testimonials they provide may be used for marketing purposes. Personal identifiers will only be included with explicit written consent.

17. Privacy and Confidentiality

17.1 We respect your privacy and will only use your personal information for Course delivery and support.

17.2 Participants are expected to maintain the confidentiality of others within the private community.

18. Dispute Management

18.1 In the event of any disputes arising from your participation in the Course, participants agree to attempt resolution through direct communication.

18.2 If the dispute cannot be resolved informally, it shall be submitted to mediation or arbitration in New Zealand under the applicable laws and regulations governing dispute resolution in New Zealand.

18.3 Both mediation and arbitration will be conducted in New Zealand and in accordance with New Zealand dispute resolution frameworks.

18.4 The costs of mediation or arbitration will be shared equally between both parties unless otherwise agreed.

19. Limitation of Liability

19.1 To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, incidental, or consequential damages arising from your participation in the Course.

19.2 Our total liability is limited to the amount paid for the Course.

20. Amendments and Updates

20.1 We reserve the right to amend these Terms as needed. Participants will be notified of significant changes.

20.2 Continued access to the Course constitutes acceptance of the amended Terms.

22. Governing Law and Dispute Resolution

22.1 The laws of New Zealand govern these Terms.


22.2 Any disputes must first be addressed through direct communication. If unresolved, disputes shall be subject to the exclusive jurisdiction of New Zealand courts.

By enrolling in the Regulation Foundations course, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
